Your rights and obligations

The following terms and conditions apply to all Lions Basketball Academy programs.

PART A – TERMS AND CONDITIONS

1. Suspensions and Cancellations by the Supplier

(a) If a Program cannot proceed or be completed due to a Force Majeure Event (e.g., adverse weather, pandemics, government restrictions), Lions Basketball Academy (the Supplier) may suspend or cancel the program.

(b) We will notify you promptly and make reasonable efforts to reschedule within 12 months and within a 20-kilometre radius.

(c) If rescheduling is not possible or you cannot attend the rescheduled date, we will provide either a credit for future services or a refund of 50% of the Price paid.

(d) Refunds are not available for Suspended Programs except under clause 1(c).

(e) Unused credits expire after 3 years and are transferable.

(f) These clauses are subject to rights under NSW Consumer Law.

2. Provision of Services

(a) By enrolling, you appoint Lions Basketball Academy to deliver training as per the program details.

(b) We reserve the right to make reasonable changes to program details and will notify you of such changes as early as possible.

3. Supplier’s Rights

We reserve the right to:
(a) Restrict participation based on coaching and training requirements.

(b) Amend participation due to player skill, health, or safety concerns.

(c) Suspend or terminate participation due to breach of obligations or non-compliance with academy policies.

4. Participant’s Obligations

Participants must:
(a) Comply with all academy policies and directions from coaches.

(b) Confirm they are physically fit to participate and disclose any medical conditions or injuries.

(c) Not engage in reckless behavior or use substances (e.g., alcohol, drugs) before or during the program.

5. Your Obligations

As a parent or guardian, you agree to:
(a) Pay the program fees when registering.

(b) Ensure accurate medical disclosures and emergency information.

(c) Ensure that participants understand and agree to comply with all relevant policies.

(d) Notify us of any changes to contact information, medical conditions, or scheduling conflict

6. Your Warranties

You warrant that:
(a) You have the legal authority to make the booking for the participant.

(b) If the participant is under 18, you are their parent or legal guardian.

7. Medical Assistance

(a) By enrolling, you consent to us providing first aid or calling an ambulance in the case of injury or illness during a program.

(b) Parents or guardians will be notified of any such treatment and are responsible for any associated costs.

8. Cancellations by You

  • Please refer to the refund and cancellation policy as previously outlined.

9. Events Beyond the Supplier’s Control

In the event of a Force Majeure Event (e.g., pandemics, natural disasters), we will not be liable for delays or cancellations caused by these events. We will use reasonable efforts to resume the program and keep you informed.

10. Images of Participants

(a) Unless otherwise notified, you consent to Lions Basketball Academy using images or video of the participant for marketing purposes. Participants will not be identified by name without prior consent.

(b) You waive any rights to fees or royalties for the use of such media.

11. Privacy

You consent to us collecting personal information in line with our Privacy Policy, which is available on our website. This information is used solely for administration and communication regarding the program.

12. Applicable Law and Severability

(a) This Agreement is governed by the law of New South Wales.

(b) If any part of this agreement is deemed unenforceable, it shall not affect the enforceability of the remaining terms.

PART B –RISK AND LIABILITY

RISK WARNING

Participation in basketball involves physical activity, which carries inherent risks, including injury or death. You acknowledge and accept these risks voluntarily.

Exclusion of Liability – NSW Consumer Law

Lions Basketball Academy excludes all liability for injuries resulting from participation in programs, except where due to gross negligence or conduct that violates the NSW Fair Trading Act 1987 and Australian Consumer Law (NSW). You are not entitled to sue for compensation unless the injury results from gross negligence.

Release and Indemnity

By participating, you release Lions Basketball Academy and its staff from liability for any claims arising from participation, except for those resulting from gross negligence.

PART C – DEFINITIONS

Key Definitions:

  • Program: Refers to training, camps, and any other services offered by Lions Basketball Academy.
  • Force Majeure Event: Includes natural disasters, pandemics, or government restrictions that prevent program delivery.
  • Participant: The individual enrolled in the academy’s programs.
